The fight over Lindsay Halligan’s authority has triggered a furious legal scramble as new evidence surfaces that puts James Comey in deeper jeopardy.

STEVE BANNON (HOST): The viceroy is with us, Mike Davis. Mike, so Natalie has just told us who is doing this. I mean if you watch MSNBC, they’re beating themselves on the chest of how great a strategy this is. Are they going to get Halligan, are they going to get Halligan off this case, sir?
MIKE DAVIS (GUEST): Well, even if they have some Democrat appointed judge temporarily get her off this case, it will get appealed up through the appellate system to the Supreme Court, and I think the Supreme Court is going to side with the Trump Justice Department on this. She was appointed based upon a statute giving her a 120 day appointment, and then the Attorney General Pam Bondi also made her a special attorney to the Attorney General, so she has full authority to do what she is doing, and they could just make her the first assistant U.S. attorney, and she can continue doing her job as the first assistant.
Here is the bottom line. They may try to get some Democrat judge to temporarily knock these U.S. attorneys out of their positions, but it is not going to fix their problem. If you look at what Halligan has done so far in response, for example, to Comey’s motion to dismiss the indictment for selective prosecution, she showed overwhelming evidence in response to that that Comey lied to Congress and obstructed the congressional investigation.
She just put out more evidence today when Comey asked for a bill of particulars. This evidence is very damning against James Comey, and I can see why these Democrat activists are running Democrat judges to try to get rid of Halligan.
STEVE BANNON (HOST): I want the audience to understand that these filings are solid. They are trying to make a case that there is no evidence on Comey and they did not file anything, and the judges are upset. They are asking again today because they are trying to build a narrative that the Trump Justice Department is just a group of unprofessional savages that run into court with indictments but then do not have anything, not ready to go to trial, they have not done anything. What are the facts here, Mike as you see them.
MIKE DAVIS (GUEST): But the facts are that, with Kash Patel and Dan Bongino and Senator Chuck Grassley’s office, they have unearthed tremendous evidence of guilt against James Comey for lying about the Russian collusion hoax, Crossfire Hurricane, lied about these ongoing investigations, obstructing congressional investigations. Lindsay has shown the receipts and she is doing it the appropriate way.
It is Comey who is inviting this. He is filing these motions, the motion to dismiss the indictment, the motion for a bill of particulars, and in response to each one of those Lindsay Halligan has shown her receipts. And again, this evidence is overwhelming and it is damning.
Now, of course, he gets to go to trial. He can put on his own evidence. He can confront the evidence and the witnesses against him with cross examination. He is presumed innocent, all of that. But if you look at this evidence with his own emails, if we have a fair judge and a fair jury, Comey is going to prison.
